This version replaces all previous versions of these Terms.

1. Who we are

Mivton ("Mivton", "we", "us") is a service operated by Silviu Timaru Solutions, a sole proprietorship registered in Poland (CEIDG).

By using Mivton you agree to these Terms. If you do not agree, do not use the service.

2. What Mivton is

Mivton is a music listening platform. It allows you to:

• listen to live DJ broadcasts and a continuous radio stream;
• enter a shared listening room where other listeners are present and can chat in real time;
• invite one other person, using a single-use link ("a key"), into a private room for two, where you listen together and chat privately;
• post a public message to our message wall.

Mivton is provided as-is and is under active development. Features may change, be added, or be withdrawn.

3. You must be 18 or older

Mivton's rooms are for adults only. You must be at least 18 years old to enter any room.

Before entering a room you will be asked to verify an email address and to confirm, by ticking a box, that you are 18 or older and that you accept these Terms and our Privacy Policy. That confirmation is recorded.

If you are under 18, you may not enter any room, send or accept a key, or create an account. If we become aware that a user is under 18, we will terminate their access and delete their data.

Providing a false age declaration is a breach of these Terms.

4. Your account and verification

To post on the wall or enter a room, you verify an email address by receiving a six-digit code. You choose a display name that other users can see.

You are responsible for:

• keeping access to your email account secure;
• everything done through your session;
• the accuracy of the information you give us.

Do not impersonate another person, and do not use a display name that is offensive, misleading, or that impersonates someone else.

5. Rooms: what is public and what is private

The shared room. Anyone who has passed the age gate may enter. Your display name is visible to everyone in the room. Messages you send in the shared room are visible to everyone in the room. Do not share personal information you would not want others to see.

Private rooms for two. When you send or accept a key, you enter a room with one other person. Chat in a private room is not shown to other users and is not routinely monitored by us. Messages in rooms are held in memory for delivery and are not stored as a permanent record by us.

Important: because we do not monitor private rooms, we cannot see what happens in them unless someone reports it. You are entering a private conversation with another adult. Use your judgement. Only share a key with someone you choose to share it with.

6. Rules of conduct

You must not use Mivton to:

• harass, threaten, stalk, bully, or abuse any person;
• share sexual content involving anyone under 18, or content that sexualises a minor in any way. This is an absolute prohibition and we will report it to the relevant authorities.
• share sexual content with a person who has not consented to receive it;
• share content that is hateful or discriminatory on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, or sexual orientation;
• incite or threaten violence;
• share another person's private information without their consent;
• solicit money, promote scams, distribute malware, or advertise commercial services;
• infringe anyone's intellectual property rights;
• attempt to access parts of the service you are not authorised to access, interfere with the service, scrape it, or circumvent the age gate or any other technical measure;
• use automated means to create accounts or enter rooms;
• do anything unlawful under Polish or EU law, or under the law that applies where you are.

7. Reporting

Every room includes a report control. If someone behaves in a way that breaches these Terms, use it.

A report records the type of room, its identifier, the time, and your verified identity. It does not send us the contents of your conversation.

If you believe a user is under 18, or if you encounter content that sexualises a minor, report it immediately. We treat this as our highest priority.

8. What we may do about breaches

We may, at our discretion and where proportionate:

• remove content;
• suspend or terminate your access, permanently if necessary;
• decline to provide the service to you in future;
• report unlawful conduct to law enforcement and preserve relevant records where we are legally required or permitted to do so.

Where the law requires it, we will tell you the reason and how to contest the decision.

9. Content you post

You keep ownership of anything you post. By posting a message on the public wall, you grant us a non-exclusive, worldwide, royalty-free licence to display and store that message as part of operating the service. You can ask us to remove it.

You confirm you have the right to post whatever you post.

10. Music and intellectual property

Music broadcast on Mivton is played by us under our own rights and licences. You may listen to it. You may not record, re-broadcast, download, or redistribute it.

The Mivton and SILVR names, the site design, and the software are ours. You may not copy or reuse them without permission.

11. Availability

Mivton is provided free of charge and without any guarantee of availability. We may change, suspend, or discontinue any part of it, including your access, at any time. We will make reasonable efforts to give notice where a change materially affects you.

12. Liability

To the fullest extent permitted by law, we are not liable for:

• the conduct of other users, whether online or if you choose to meet them;
• anything said or shared in a private room;
• loss or corruption of data;
• interruptions to the service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be excluded.

If you are a consumer in the EU, these Terms do not affect your mandatory statutory rights under the law of the country where you live.

13. Meeting other users

Mivton connects you with people you may not know. If you choose to communicate with, meet, or otherwise engage with another user beyond the platform, you do so at your own risk. We do not verify the identity of users beyond an email address and a self-declared age. Take the precautions you would take with any stranger.

14. Ending your use

You may stop using Mivton at any time, and you may ask us to delete your account and data — see the Privacy Policy for how.

We may terminate your access if you breach these Terms, or if we discontinue the service.

15. Changes to these Terms

We may update these Terms. Each version carries a version date at the top.

If we make a material change, the next time you enter a room you will be asked to read and accept the new version before continuing. Your acceptance of each version is recorded.

16. Governing law and disputes

These Terms are governed by the law of Poland.

If you are a consumer, you may bring proceedings in the courts of the country where you live, and you keep the protection of the mandatory consumer law of that country.

EU consumers may also use the European Commission's Online Dispute Resolution platform.
